Terms & Conditions
Subscription fees are payable monthly or annually in advance.
Payments shall be made via Providers recurring online invoicing using payment methods e.g., credit card, bank transfer. Payments are due on the start of each agreed billing cycle.
Automatic Renewal: Subscriptions will automatically renew unless cancelled by the Client according to the cancellation policy. The Client will be notified prior to any automatic renewal.
In case of non-payment, the Provider reserves the right to suspend or terminate the Services.
Client Responsibilities
The Client agrees to:
a. Provide the Provider with read-only access to their website analytics account.
b. Provide accurate and complete information regarding their website and business goals.
c. Designate a primary contact person for communication regarding the Services.
d. Provide timely feedback or clarification on the recommendations provided in the reports.
e. Comply with all applicable privacy regulations (e.g., GDPR, CCPA) regarding the collection and use of website visitor data, including obtaining necessary consents where required.
f. Maintain the security of their account credentials for accessing the analytics platform.
Data Access and Privacy
The Provider accesses and analyzes data directly from the Client’s website analytics account to provide the Services.
The Client acknowledges that the data belongs to the Client.
The Provider will use the accessed data solely for the purpose of providing the Services and will not sell or share Client data with third parties without the Client’s consent, unless required by law.
The Client should refer to the Provider’s Privacy Policy (https://www.tiny-panda.com/privacy-policy) for detailed information on how data is collected, used, and protected.
Termination
a. The Provider may terminate the Services with a notice period of 30 days if the Client fails to make payments or breaches these Terms that are not cured promptly.
b. In the event, that the Client terminates their subscription before the end of the current billing cycle, the Client agrees to pay the full amount due for the remaining months of that cycle. The minimum subscription term is 12 months. This payment is due immediately upon notification of termination.
c. Upon termination, the Provider will cease accessing the Client’s website analytics data after the end of the final billing cycle.
Disclaimers and Limitation of Liability
a. Data Accuracy: The Provider strives to provide accurate analysis and recommendations based on the data available in the Client’s website analytics reports, but cannot guarantee the absolute precision or completeness of the data itself, which is subject to the limitations of the underlying analytics platform.
b. Website Performance: The Services are designed to help the Client understand and improve website performance but do not guarantee specific improvements in traffic, conversions, or business outcomes.
c. Limitation of Liability: The Provider’s total liability arising out of or related to these Terms shall not exceed the total amount paid by the Client for the Services during the specified time period, e.g., 12 months, immediately preceding the event giving rise to the claim.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, England and Wales.
Entire Agreement
These Terms constitute the entire agreement between the Provider and the Client regarding the Services described herein and supersedes all prior discussions or agreements.
Acceptance
By accepting a subscription plan and utilizing the Services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
Subscription Agreement
Introduction
These Terms and Conditions (the “Terms”) govern the agreement between Tiny Panda Graphic Artists Ltd (the “Provider”) and the Client for the provision of tiered website analytics interpretation and marketing recommendation services (the “Services”). The Services are based on the data available within the Client’s existing website analytics reports. By accepting a subscription plan and subsequently utilizing the Services, the Client agrees to be bound by these Terms.
Services
The Provider agrees to provide website analytics interpretation and marketing recommendation services to the Client, based on the selected subscription plan. The Services involve analyzing the data presented in the Client’s existing website analytics reports and providing insights, recommendations, and actionable plans for website development and improvement. This includes, but is not limited to:
a. Report Interpretation: Regular review and evaluation of key metrics and trends presented in the Client’s website analytics reports, focusing on the following specific reports:
i. Overview Report: Providing a high-level summary of website activity, including total visitors, sessions, page views, and key engagement metrics for a selected period.
ii. Traffic Sources Report: Identifying where visitors originate from (e.g., search engines, social media, direct traffic, referrers) and analyzing the performance of each source.
iii. Behavior Report: Understanding how visitors interact with the website, including metrics like bounce rate, average session duration, pages per session, and exit pages.
iv. Pages Report: Monitoring the performance of specific website pages and content based on metrics like page views, unique page views, average time on page, and bounce rate.
v. Geography Report: Identifying the geographical location of website visitors (e.g., country, city) and analyzing trends.
vi. Device Report: Tracking the types of devices (desktop, mobile, tablet) used by visitors to access the website.
b. Insight Generation: Identifying significant patterns, anomalies, and areas for improvement within the website data.
c. Actionable Recommendations: Providing specific, data-driven suggestions for optimizing website performance, user experience, conversion rates, and overall effectiveness.
d. Development Planning: Outlining clear steps and strategies for implementing the recommendations to achieve website goals.

g. Search Engine Optimization (SEO) Strategy & Content Plan: A plan for improving search engine visibility, including keyword research, on-page optimization recommendations, technical SEO considerations, and a content calendar outline.
h. Email Marketing Strategy & Content Plan: A plan for effective email campaigns, including segmentation strategies, content types (e.g., newsletters, promotional emails), and campaign schedules.
i. Social Media Strategy & Content Plan: A plan for leveraging social media platforms, including platform selection, content themes, posting schedules, and community engagement tactics.
